New BMC Rules Every Pet Owner in Mumbai Must Know – Major Changes for Stray Animal Care Too

The Brihanmumbai Municipal Corporation (BMC) has formulated new guidelines which aim to prevent unwanted conflicts and, at the same time, ensure the safety and well-being of citizens and animals.

These guidelines have been clearly articulated regarding pet ownership, feeding stray canines as well as responsibilities of housing societies and institutions in Mumbai.

In the past, there have been instances of altercation between pet owners and other residents in housing colonies of Mumbai.

Resident Welfare Associations (RWAs) and Apartment Owners Associations (AOAs) often forbid pet owners from using lifts and public spaces along with their pets.

There has been a surge in stray feeders in Mumbai, and their activities have been opposed by housing societies.

The new guidelines have been finalised on the basis of directives from the Apex Court of the nation, the Animal Welfare Board of India (AWBI), and the Animal Birth Control (ABC) Rules, 2023.

The directives are as follows-

Registration of Pet Dogs Now Obligatory

Section 191B of the Mumbai Municipal Corporation Act, 1888, clearly stipulates that every pet within the municipal limits must be registered with the BMC.

It is illegal for anyone within the Mumbai Municipal limits to keep a pet which has not been registered.

The guidelines also put the responsibility on pet owners to vaccinate and deworm their pets and, if possible, sterilise them.

Dogs must not be taken around in public places without a leash, and their droppings must be immediately picked up by the pet owners.

The person who is taking the dog in public places must be above the age of 18.

Societies Forbidden to Ban Pets or Feeders

Resident Welfare Associations (RWAs) and Apartment Owners Associations (AOAs) have been restrained from preventing pets from communal places within the residential complex or on lifts.

They cannot also restrict the feeding of stray animals by entities, though they can fix a time for the feeding. The directives clearly state that harassing feeders or animals can invite a prison sentence.

The entities have also been asked to set up Animal Welfare Committees for resolving any disputes, and also carry out sterilisation as per ABC rules.

Procedure for Animal Feeders

Feeders have been instructed to feed in clean and well-marked spots away from playgrounds and play areas for kids.

The feeding activity must be limited to early morning or late evening.

The food must not include raw meat or stale food.

Feeders must also participate in vaccination and sterilisation drives.

Directives for Institutions

Schools, IT parks, and other public institutions have been instructed not to relocate the stray animals to their premises.

Ideally, they must be sterilised, vaccinated, and returned to their territory. Institutions are expected to provide food, water, and shelter, and staff must be trained accordingly.
